LightLore operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). LightLore is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province or country of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing information, payment information and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity associated with your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make every reasonable effort to represent our products and services accurately in our online store. However, colors and product appearance may differ from how they appear on your screen due to the device, display settings and lighting conditions you use.

Many LightLore products are handmade. Small differences in color, shape, size, pattern, bubbles, texture and finish may naturally occur. These variations are part of the handmade character of the product and do not necessarily constitute defects.

For custom products, the final form, colors, details, price and estimated production time will be confirmed in writing before payment. Reference images may be used to communicate a color, feeling or general direction, but they do not guarantee an exact replica unless we expressly confirm otherwise in writing.

All product descriptions are subject to change without notice at our discretion. We reserve the right to discontinue a product at any time and may limit the quantities offered to any person, geographic region or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. LightLore reserves the right to accept or decline your order for any lawful reason. Your order is accepted when LightLore confirms acceptance and receives or processes your payment.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation or modification requests after production or order processing has begun, especially for personalized and custom products.

If we decline, change or cancel an order, we will attempt to notify you using the email address, billing address or phone number provided with the order. If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

Purchases are subject to our Refund Policy, available at /policies/refund-policy.

You represent and warrant that your purchases are for personal or household use and are not intended for unauthorized commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect when the order is placed and will be shown in your order confirmation.

Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping fees, handling fees, customs duties or import charges. Customers are responsible for customs duties, import taxes and similar charges imposed by the destination country unless we expressly state otherwise.

Prices in our online store may differ from prices offered in physical stores or through third-party sellers. Promotions may be governed by terms separate from these Terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

You agree to provide current, complete and accurate purchase, payment and account information. You agree to update your information when necessary so that we can complete transactions and contact you about your order.

You represent and warrant that the payment information you provide is accurate, that you are authorized to use the selected payment method and that the applicable charges will be honored by your payment provider.

SECTION 5 - SHIPPING AND DELIVERY

Production, dispatch and estimated delivery times are stated on our website, product pages or confirmed in writing for custom orders. After dispatch, delivery typically takes approximately seven business days, although carrier or customs delays may occasionally occur.

If we cannot dispatch an order within the timeframe we communicated, we will contact you with a revised date. You may accept the delay or cancel the unshipped order for a full refund.

LightLore remains responsible for resolving packages that arrive damaged, defective or incorrect in accordance with our Refund Policy. If tracking shows delivery but you cannot locate the package, please contact us promptly so that we can review the shipment with the carrier.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brand names, text, displays, images, graphics, product reviews, videos, audio, designs and the selection and arrangement of such materials, are owned by LightLore, its affiliates or licensors and are protected by applicable copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services without our prior written consent.

Except as expressly provided herein, nothing in these Terms grants or shall be interpreted as granting you a license or other rights under any trademark, copyright or other intellectual property belonging to LightLore, Shopify or a third party. All rights not expressly granted are reserved by their respective owners.

LightLore’s names, logos, product names, service names, designs and slogans are trademarks of LightLore or its affiliates or licensors. You must not use them without prior written permission. Shopify’s name, logo, product names, service names, designs and slogans are trademarks of Shopify. Other names, logos, product names, service names, designs and slogans appearing through the Services belong to their respective owners.

You may be provided with access to tools offered by third parties as part of the Services. We do not monitor and have no control over these tools.

You acknowledge and agree that access to these tools is provided “as is” and “as available,” without warranties, representations, conditions or endorsement of any kind. To the extent permitted by applicable law, we will not be liable for issues arising from your use of optional third-party tools.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

LightLore is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and LightLore.

By using the Services, you acknowledge that Shopify is not the seller of LightLore products and is not responsible for the fulfillment, quality or performance of products purchased from LightLore. To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from your purchase transaction with LightLore.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled according to our Privacy Policy, available at /policies/privacy-policy. Certain personal information may also be processed subject to Shopify’s Privacy Policy, available at https://www.shopify.com/legal/privacy/app-users.

Because the Services are hosted by Shopify, Shopify collects and processes information concerning your access to and use of the Services to operate and improve the platform.

Information submitted through the Services may be transmitted to and processed by Shopify and other service providers, including providers located outside the country where you reside. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIGHTLORE AND ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

THIS LIMITATION DOES NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. IT ALSO DOES NOT REMOVE ANY EXPRESS REMEDY PROVIDED UNDER OUR REFUND POLICY FOR A PRODUCT THAT ARRIVES DAMAGED, DEFECTIVE OR INCORRECT.

SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless LightLore, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party losses, damages, liabilities or claims, including reasonable legal fees, arising from:

(1) your material breach of these Terms or documents incorporated by reference;

(2) your violation of applicable law or the rights of a third party; or

(3) unlawful or unauthorized use of the Services.

We will notify you of an indemnifiable claim. Failure to provide prompt notification will not relieve you of your obligations unless the delay materially prejudices your ability to respond.

We may control the defense and settlement of the claim at our expense or, when legally permitted and reasonably appropriate, require your cooperation with the defense. We will not agree to a settlement that imposes a non-monetary obligation on you without your consent.

SECTION 19 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law. Any unenforceable portion will be severed without affecting the validity and enforceability of the remaining provisions.

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and operating rules posted through the Services, constitute the agreement between you and LightLore concerning your use of the Services. They supersede prior or contemporaneous agreements and communications concerning the same subject matter.

Any ambiguity in these Terms will be interpreted fairly and according to applicable law.

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent.

We may transfer or assign these Terms and our rights and obligations in connection with a business reorganization, sale, merger, transfer of assets or change of service provider, subject to applicable law.

SECTION 22 - GOVERNING LAW

These Terms of Service and any separate agreements through which we provide the Services are governed by the laws applicable where LightLore is headquartered.

Any dispute will be submitted to the courts with jurisdiction in Wuhan, Hubei, China, except where mandatory consumer protection laws in your place of residence provide otherwise.
